      實施工程總承包,業主要特別注意的9個方面


          工程总承包模式通过对设计、采购和施工等阶段的全过程承包、全过程管理,达到项目效益最大化。
          对于业主来说,选择工程总承包建设模式,有哪是特别需要注意的呢?
          1、工程總承包的定義
          工程总承包是指从事工程总承包的企业按照与建设单位签订的合同约定,对建设工程的勘察、设计、采购、施工等实行全过程或若干阶段的承包,并对工程的质量、安全、工期、造价等全面负责的建设工程组织实施方式。
          2、工程總承包模式的優缺點
          2.1、优点
          实施工程总承包可以:
          1)提高工程项目建设管理水平,有效控制建设投资、加快建设进度、提高工程质量和效益;
          2)可以促进设计与施工深度融合,激发工程建设科技创新;
          3)可以规范建筑市场秩序,有效遏制违法发包和转包、违法分包、挂靠等违法违规行为;
          4)可以推进大型勘察设计、施工企业的结构调整和资源整合,加快与国际接轨。
          2.2、缺点
          1)业主需要进行大量详实而准确的前期工作,并能够对项目造价有较为准确的估量,对业主前期工作质量要求高;
          2)与现行法律法规的一些不适应,如不能解决施工许可证中承包单位的法律地位问题;
          3)需要业主支付一笔可观的总承包单位管理费,通常为2-3个点或更高,或采用固定总价,总承包单位依靠风险投资,集团采购进行获利。
          3、工程總承包模式實踐中遇到的幾點問題
          3.1、工程项目实施总承包模式的前提条件不成熟
          因项目前期工作不充分、不到位,没有充分考虑项目自身的情况及项目建设的客观情况,特别是在土地政策处理、项目周边环境、项目周边基础设施情况、项目方案充分论证、项目初步设计等方面没有做细,深度不够,从而导致工程总承包实施的条件不成熟,带来后续诸多的问题。
          3.2、对应的管理人员和人才储备缺乏
          掌握项目建设全过程管理经验与能力的人员甚少,具备总承包管理模式的项目负责人匮乏,相关的管理经验积累更是稀缺。
          3.3、设计与施工的配合与衔接仍有待改进
          在项目建设过程中,设计图纸的出图情况及图纸质量问题严重影响项目建设的推进情况。
          设计图纸不能及时有效的出全,导致后续不能实施工程施工总承包,设计图纸质量严重影响工程投资控制和工程进度推进,图纸深度不够导致二次设计的情况屡见不鲜,部分功能缺失也时有发生。
          以上情况都是在初步设计没有做深做细的直接后果。
          4、工程總承包項目具體實施的建議
          4.1有区别地选择工程总承包项目
          针对工期要求紧,质量要求高,结构异常的,新材料、新设备较多的项目开展工程总承包,充分发挥工程总承包在工期、质量、设计施工协调配合中的优势与经验。
          从工程总承包报价、总承包组织管理方案、建安工程报价、设计技术方案、设备采购方案、施工组织设计、完成的相应工程业绩等方面选定优秀的总承包单位。
          选择此类工程的优点是,规避了建设管理单位在高、新、异的项目管理经验上的不足,避免了因类似经验不足带来的实施管理的不确定性。
          缺点就是在发包阶段如何充分做好前期的深化,确保最终的各项功能及美观需求等都得到满足,并在发包阶段如何较为准确的确定发包的最高限价,保证承包商的合理利润。
          4.2落实建设用地
          建设单位首先要解决土地问题,确保土地在权属及在规划划定的红线范围内无权属纠纷并协助解决与周边环境的有可能纠纷。需要国土、规划和建设单位在进行工程总承包单位招标前确定好。
          4.3施工场地准备
          建设单位应在项目建设规划阶段充分了解周边基础设施配套情况,具体有进场道路、给水、用电、燃气、通讯接入;排水、排污接出。
          以上基础设施是否完善直接影响到项目开工进度及投入使用的时间,也与工程总承包单位考虑报价有一定的影响,应在招标前摸清情况,在招标时告知承包单位。
          4.4初步设计报批
          建设单位仍应委托设计单位做好项目方案设计及初步设计报发改委审批。设计单位应充分领会建设单位意图,并充分考虑对后续施工图影响的情况下,对功能布局及档次定位作出明确要求。
          一些业主要求的特殊情况,应在初设说明里加以明确,确保能在后续施工图中进行体现。
          将初步设计概算作为工程总承包发包的造价依据。与目前施工图预算作为招标控制价的依据有所不同,建议初步设计概算进行财政评审后作为招标控制价依据,需要财政局(含财政评审)对此进行认可,并出具评审报告。监管办、交易中心等单位应对财政评审出具的报告,同意作为招标控制价依据。
          4.5招标要求
          在工程发包阶段建设单位依据经审批同意的初步设计,以工程概算为经济控制指标采用限额设计,以有关技术规范、标准和确定的建设规模、建设标准及工程质量、工期进度要求为标的,开展工程总承包的招标
          工程总承包项目可采用固定总价、固定单价或价格估算指标(指数)等方式确定合同造价,工程总承包合同参照住房和城乡建设部、国家工商总局联合印发的《建设项目工程总承包合同示范文本》(GF-2011-0216)制定。
          4.6相关政府监管职能部门的职责转变
          为体现工程总承包的优越性,相关政府监管职能部门要积极实践,改进建设项目规划许可、招标投标、施工图审查、合同备案、质量安全监督、施工许可、竣工验收备案及工程结算等环节的管理制度和流程。
          工程总承包通常项目规模大,单位工程多,施工图纸通常分专业分阶段进行,建设主管部门和施工图审查机构可根据工程的实际情况,分部位,分阶段进行施工图审查,并办理工程质监、安全监督、施工许可、规划许可等手续,可加快项目开工。
          4.7监督管理环节
          建设行政主管部门在对工程总承包项目实施监督管理时,除勘察、设计、施工、监理等五方主体外,将工程总承包企业及其项目负责人作为工程建设责任主体,依法监督其履行勘察、设计、施工、采购的工程质量安全和建筑市场行为主体责任。
          4.8选择有经验的工程招标代理咨询机构
          利用代理机构的经验,借鉴省内外其他地方的实践经验,结合本地特点进行综合考量,能够减少一些承包实践当中经验不足造成的缺陷。
          4.9选定工程总承包企业
         选定有实力、有经验、社会信誉好的工程总承包企业,是保证工程总承包项目实施成功的必要条件。因为工程总承包是以初步设计图纸作为要约参考,初步设计的深度不可能详细到事事描述清楚的地步。选定的工程总承包企业一定要有社会责任感的企业,对自己的建筑产品有一定的品质追求,否则只靠合同及初步设计图纸的约定,难以建成建设单位满意的建筑产品。
          结语
          推行工程总承包是政府建设市场改革的方向,从省内其他县市的实践情况看,实施工程总承包可以提高工程项目建设管理水平,有效控制建设投资、加快建设进度,提供工程质量和效益。有必要在不断摸索、积累实践经验的基础上全面推广实施。
